DGTO cancels Pak Iran Joint Chamber of Commerce and Industry, six other TOs’ licenses

TOs failed to comply with Rule 6 of Trade Organizations Rules, 2013 : DGTO order

LAHORE: Directorate of General Trade Organizations has cancelled licenses of seven Trade Organisations including Pak Iran Joint Chamber of Commerce and Industry as the chambers and trade organisations failed to meet requirements, Daily The Business has learnt.

“The subject TOs namely Pak Iran Joint Chamber of Commerce and Industry, All Pakistan Carbon Solvent Importers Association, Chaghi Chamber of Commerce and Industry, Pakistan Alloy Rim Manufacturers Association, Submersible Pumps Importers Association, Musa Khail Chamber of Commerce and Industry and Qilla Saifullah Chamber of Commerce and Industry have failed time and time again to complete codal formalities as prescribed in Trade Organizations Act, 2013 and Trade Organizations Rules, 2013.

“Particularly, they have failed to comply with Rule 6 of Trade Organizations Rules, 2013, and in provision of documents as required by order in original number 79/2020 dated 20-10-2020.

“The licenses of the above mentioned TOs stand cancelled under Section 7 of Trade Organizations Act, 2013 with immediate effect. The matter stands disposed of accordingly,” an order passed by DGTO Riaz Ahmad Khan said.

By the order the DGTO intends to decide the fate of Trade Bodies in compliance of Honourable Balochistan High Court, Quetta order dated 22-10-2020, passed in Contempt Application Number 19, 57, 58, 65 to 68, 70 to 72, 74, 76 & 77/2019, the order said.

The background of the case is that the Regulator TO heard the following seven TO’s on 19-10-2020 and passed an order in original number 79/2020 dated 20-10-2020 in compliance of Honorable Balochistan High Court, Quetta order dated 7-10-2020, the order said, adding that the respondents were given 15 days to complete codal formalities against various notices sent to the respondents, however, all the TO’s namely Pak Iran Joint Chamber of Commerce and Industry, All Pakistan Carbon Solvent Importers Association, Chaghi Chamber of Commerce and Industry, Pakistan Alloy Rim Manufacturers Association, Submersible Pumps Importers Association, Musa Khail Chamber of Commerce and Industry and Qilla Saifullah Chamber of Commerce and Industry failed to meet the requirements, the order added.

In the light of arguments heard and record, evidence perused, the DGTO passed following: The subject TOs have failed to provide documents in accordance with DGTO directions and provisions of Trade Organizations Act, 2013 and Trade Organizations Rules, 2013 while the TOs are provided a final opportunity, inter alia, to provide the following documents within 15 days of issuance of this order.

i The original lease agreements and their certified copies attested by the respective Secretary Generals of every TO along with proof of payments.

ii. Bank statements with details of all transactions conducted over the last three years certified by the issuing competent authority.

iii. Attested Minutes of Meeting of appointment of Human Resource Committee for appointment of Secretary General as per Rule 24 of TORs, 2013.

The requisite documents must be attested by the Secretary General on the letterhead of TO.

iv. Record of membership of the members of the past three years attested by the current Secretary General.

V Election results for the last three years attested by the respective Secretary Generals on the letterheads of the TOs.

vi. Membership record including renewal slips of the last three years attested by the respective Secretary Generals of TOs.

vii. Declaration before the Auditors and audited financial reports signed and attested by the auditor.

vii. Proof of regional offices of Association with utility bills and proof of payment of rent”

As per the DGTO findings the subject TO’s were given a time-period of 15 days which expired on 4th November 2020, to complete all codal formalities as per directions of DGTO given in the order reproduced above and in notices, show-causes issued to the subject TOs. However, after the lapse of the given time period, no new document, evidence has been presented that bars the cancellation of the subject TOs as per provisions of Section 7 of Trade Organizations Act, 2013.

On the other hand, in another similar case of Women Chamber of Commerce and Industry, Quetta, the federal secretary of Commerce Muhammad Sualeh Farruqui has upheld the decision of the cancellation of license of the organization by the DGTO in a hearing held the other day.

The secretary decided the case on an appeal  filed by the president of the Women Chamber of Commerce and Industry, Quetta.

However, the cancellation of five chambers and associations including Pak Iran Joint Chamber of Commerce and Industry, All Pakistan Carbon Solvent Importers Association, Chaghi Chamber of Commerce and Industry, Pakistan Alloy Rim Manufacturers Association and Submersible Pumps Importers Association has been held, according to a circular of DGTO. .
